New Bill Seeks to Mandate Amtrak Refunds for cancelled or delayed

A newly proposed bill in the U.S. House of Representatives aims to establish stricter consumer protections for Amtrak passengers by ensuring automatic ticket refunds when trains are significantly delayed or canceled due to Amtrak’s own failures.

Legislation Introduced After Delays and Cancellations

Representative Josh Gottheimer (D-N.J.), alongside co-sponsor Rep. Thomas Kean (R-N.J.), formally introduced H.R. 769 on January 28, pushing forward a plan first announced in August 2024. The bill has been referred to the House Committee on Transportation and Infrastructure for further deliberation.

Although initially planned for introduction in the previous legislative session, the bill was delayed due to technical drafting and negotiations. Tony Wen, a spokesperson for Gottheimer, explained, “It can take time to draft and negotiate the technical details, but the ultimate outcome will be worth it.”

Passenger Bill of Rights Included

While the full text of H.R. 769 has yet to be published on the Congress website, Gottheimer previously indicated that the legislation would incorporate a “Passenger Bill of Rights.” This provision would guarantee automatic, full refunds for ticket holders if an Amtrak train is canceled or delayed by more than three hours, provided that Amtrak is at fault.

The bill comes in response to persistent operational problems along the Northeast Corridor, which saw multiple service disruptions throughout 2024. These issues ultimately prompted Amtrak and New Jersey Transit to form a joint initiative aimed at improving reliability and mitigating future service disruptions.

Inspired by European Consumer Protections

This proposed legislation takes inspiration from EU Regulation 261/2004 (EU261), which mandates that airlines compensate passengers for significant flight delays, cancellations, and denied boarding within the European Union. By implementing similar protections for Amtrak passengers, lawmakers seek to bring U.S. rail travel standards in line with those already established for air travel in Europe.

Consumer Protection and Accountability

If passed, this legislation would mark a significant shift in Amtrak’s refund policies, creating clear and enforceable guidelines to protect passengers affected by preventable service failures. Currently, Amtrak’s refund policies vary depending on ticket type, route, and reason for cancellation, leading to inconsistencies in compensation.

The introduction of H.R. 769 aligns with broader efforts in the U.S. to strengthen consumer rights in the transportation sector, particularly in cases where delays and cancellations cause significant inconvenience to travelers.

The bill now awaits further discussion and potential amendments as it moves through the legislative process.
